{"id":3678,"date":"2019-10-22T07:39:56","date_gmt":"2019-10-22T07:39:56","guid":{"rendered":"https:\/\/blog.payxpert.com\/2019\/10\/22\/la-transicion-contractual-a-partir-del-brexit-y-ahora-que\/"},"modified":"2025-11-11T13:49:21","modified_gmt":"2025-11-11T13:49:21","slug":"la-transicion-contractual-a-partir-del-brexit-y-ahora-que","status":"publish","type":"post","link":"https:\/\/blog.payxpert.com\/es\/la-transicion-contractual-a-partir-del-brexit-y-ahora-que\/","title":{"rendered":"La transici\u00f3n contractual a partir del Brexit: \u00bfY ahora qu\u00e9?"},"content":{"rendered":"<p>Actualmente nos encontramos en un momento de incertidumbre por lo que respecta a las negociaciones que se est\u00e1n llevando a cabo sobre el Brexit entre la Uni\u00f3n Europea y el Reino Unido.<\/p>\n<p><!--more--><\/p>\n<p>Como todos sabemos, entre los miembros de la Uni\u00f3n Europea existe el derecho a la libre prestaci\u00f3n de servicios, y dejar de ostentar esta condici\u00f3n implica la p\u00e9rdida autom\u00e1tica del beneficio del pasaporte europeo. Por ello, en el supuesto de que se produzca un Brexit sin acuerdo las entidades brit\u00e1nicas deber\u00e1n adaptarse al r\u00e9gimen que se prevea en las distintas legislaciones, aplicable a las entidades de terceros pa\u00edses para poder continuar prestando servicios financieros en los distintos pa\u00edses.<\/p>\n<p>En PayXpert estamos permanentemente monitorizando las actuaciones de los reguladores europeos en relaci\u00f3n a los pa\u00edses donde estamos directa o indirectamente presentes como entidades de pago con licencia en UK. Os avanzamos que los reguladores han ido comunicando las actuaciones que deber\u00e1n llevar a cabo las entidades brit\u00e1nicas para continuar operando.<\/p>\n<p><img decoding=\"async\" src=\"http:\/\/test.payxpert.com\/wp-content\/uploads\/sites\/3\/2024\/10\/Brexit-Web-Image_7-1-scaled.jpg\" alt=\"Brexit-Web-Image_7 (1)\" width=\"600\" style=\"width: 600px; display: block; margin: 0px auto;\"><\/p>\n<ol>\n<li>Espa\u00f1a<\/li>\n<\/ol>\n<p>El Banco de Espa\u00f1a emiti\u00f3 en abril una nota informativa en la que comunicaba la vigencia de los contratos celebrados con anterioridad a la salida del Reino Unido de la Uni\u00f3n Europea, si perjuicio de que deba obtenerse una nueva autorizaci\u00f3n para poder gestionar estos contratos y garantizar de este modo su continuidad durante 9 meses.<\/p>\n<p>Esta situaci\u00f3n se regula en el Real Decreto-ley 5\/2019 de medidas de contingencia ante la retirada del Reino Unido de la Uni\u00f3n Europea sin que se haya alcanzado el acuerdo previsto en el art\u00edculo 50 TUE.<\/p>\n<ol start=\"2\">\n<li>Italia<\/li>\n<\/ol>\n<p>La Banca d\u2019Italia, por su parte, emiti\u00f3 en junio una comunicaci\u00f3n en la que se dispone que las entidades del Reino Unido que operan en Italia tendr\u00e1n que comunicar su intenci\u00f3n de continuar ofreciendo servicios en un plazo de 3 d\u00edas desde que le Brexit se hiciese efectivo; y que podr\u00e1n mantenerse durante un plazo de 6 meses mientras que no cuenten con una licencia otorgada por un estado miembro de la Uni\u00f3n Europea.<\/p>\n<p>Esta cuesti\u00f3n se regula en el Decreto-Legge 25 marzo 2019, n. 22, y en este enlace se contiene una tabla que resume lo dispuesto en la regulaci\u00f3n respecto de los pasos a seguir en caso de Brexit sin acuerdo.<\/p>\n<p>Aprovechamos la ocasi\u00f3n para comunicaros que estamos en pleno proceso de crecimiento logrando acuerdos con terceras partes de primera l\u00ednea, contratando los mejores profesionales y ahora tambi\u00e9n, en proceso de obtenci\u00f3n de la <strong>licencia Bancaria en Espa\u00f1a como entidad de pago<\/strong>.
